WTF: YouTube Musician Evan Emory Faces 20 Years in Prison for Clever Editing

Evan Emory, a musician who posts his material on YouTube, recently uploaded a video that might earn him 20 years in prison. Yes, you read that correctly. One totally harmless video. Twenty years in prison.

Attorneys, however, told WoodTV8 that the felony charge may be unconstitutional. Curt Benson, professor at the Thomas M. Cooley Law School, said the trial could pose “a constitutional question” because it violates Emory’s First Amendment right to freedom of speech.

So let’s back up. What’s this all about? The 21-year-old Emory posted a video of himself on YouTube singing a sexually explicit song to elementary school students. Before you take the side of law enforcement, it’s not as raunchy and inappropriate as it sounds. The video was only edited to make it appear as if young children were in the classroom, even though they weren’t. Emory posted two disclaimers on the video that elementary school students were not exposed to the explicit lyrics.

If Emory is charged with the count of manufacturing child sexual abusive material he is facing, he could spend 20 years in prison for what he says was just a joke. Muskegon County Prosecutor Tony Tague said Michigan law ‘provides penalty’ for those who actually manufacture child sexual abusive material ‘but also has a provision for those who make it appear that the children were actually abused.’

The footage of the children was recorded a month ago when Emory performed a clean song for the class, said Ravenna schools’ Superintendent John B. VanLoon (is that seriously his name? Amazing!). It was only later that Emory returned to the empty classroom to record a vulgar song, which he cleverly edited with clips of the children and posted to YouTube on Monday.

The video has been taken off YouTube because of the suit, and we were unable to find a copy of it online. Some of the sexual lyrics in the song include: “I like the way you make your body move. C’mon, girl…See how long it takes to make your panties mine…I’ll add some foreplay in just to make it fun. I want to stick my index finger in your anus.” Below is a newscast from News 8 that contains clips of the original video. You cannot hear what Emory is singing, however, and the students faces have been blurred:

If the charges are deemed unconstitutional, however, the video may be put back up.

Devin Schindler, associate professor at Cooley Law School, said it appears the charges against Emory “might violate his First Amendment right because it is overly broad.” He added the charges “appear to run afoul of the First Amendment.”

“I didn’t want to hurt anybody. I just wanted to make everyone laugh,” Emory said.

Parents are too outraged to worry whether Emory’s rights may be being infringed upon. One parent interviewed said, “He humiliated my child. He’s humiliated all the parents that are involved in it and something definitely needs to be done.”

Prior to his arrest, Emory said he owed the school “a huge apology for being deceptive and taking advantage of the fact they trusted me.”, according to WoodTV8.

However, when later asked if he regretted his decision he seemed a bit more cavalier: “I guess we’ll see how many views it gets on the Internet,” he said.

Emory’s attorney, Terry Nolan, and VanLoon appeared on HLN on Thursday night. Here’s the segment:

  1. This is ridiculous. People get offended, then they think they have a legitimate reason to “protect” their children. The fact is this guy didn’t hurt a single child in making the video, I do not understand how he has broken the law.

And adults have good reason to disapprove of and restrict him from being around them, their schools and kids even after a public apology has been made. Otherwise any kindergartener can tell you that part of being a good person is not saying or doing mean things back to someone who is not nice to you.

  13. I think the dude was way out of line. No one wants their kid’s face associated with a million views of a dude singing filthy garbage. I don’t think he should spend time in jail, but he is vulnerable to lawsuits, imo. I think an eye for an eye type thing would be applicable. He should have his face put up on a billboard with the words “tiny penis” in bold lettering.

  16. I think people, especially children, should be protected from being recorded and published, without their consent and authorization, regardless of content type, and certainly if it associates a child with illegal and or immoral behavior.

    I don’t personally want to be recorded doing anything and having it published to the planet without my express consent. If I do consent, it’s most likely as a result of an agreement whereby I will be compensated for my time, talents, and success of the production.

The only way this could cause humiliation is if Emory’s video gave us very detailed information about the children and parents so that we would know them on a “personal” level, but he didn’t. I don’t know any of the children or the fatty claiming she’s been humiliated, so I could care less. No one is going to associate those kids to this nasty video, b/c they have already been forgotten… also, it doesn’t help to report the video so that it is broadcast on the news, that gains even more attention… causing more humiliation… duh-erp

  20. Why would I be angry that my child had been in an edited video to appear to be listening to something raunchy? What is there to be angry about? My child would still be perfectly fine and only a few incredibly naive and stupid would think that the video was real. I understand parents being overprotective, but there’s nothing to protect them from here… no child is harmed.

Put ME in jail. Because scenes like this are not about The Children, but about morons showboating their absurd moral vanity.

    Dana Carvey recently hosted SNL. In the church lady skit, 16-year-old Justin Bieber made an appearance. Church lady started explicitly expressing her sexual desires in front of Bieber, saying “say my name with your voice. The voice of an angel. The voice that makes young girls naughty parts tingle. As well as some older ladies naughty parts!”

    SNL, Kimmel, and major artists like Eminem are too powerful for these silly claims to be made against them. Afterall, they are just trying to make people laugh. This poor guy tries to make people laugh using a similar theme and he’s being threatened with a 20 year sentence??

  29. Parents take their roles way too seriously even though most of them have no clue how to be decent parents in the first place. Nobody has a sense of humor and those lame parents have a short stick up their arses. They hear a joke song with sexual references and somehow remotely kids attached to the big picture of the joke and they turn it into a crisis. It’s BS. I hope Evan wins in court even though there is no real crime involved here.

  33. If someone posted a video of my son without my permission, while singing to them “I want to put my finger in your anus”, sorry folks, but that’s a violation of my son’s right to not be sexually harassed/exploited on the internet.

    The fact that he wants to use this exploitation as way to gain popularity for himself shows that this is not just a joke, but a scheme to make money. There is a law against sexualizing images of children in Michigan, the U.S. and pretty much in every country in the world.

    He could have hired kids, with their parent’s permission and avoided this trouble, but he chose to lie to them instead. I seriously doubt he’ll do jail time, but this is not simple a “freedom of speech” issue.

  36. No child was harassed. No child was spoken to inappropriately. No child was touched in any way. At most, the children suffered an invasion of privacy because video taken of them in a private setting (their classroom) was used in a humorous movie without their consent.

    The images of your children, my children, children in general — the IMAGES, mind — are not inviolable and sacrosanct. There is nothing in the Constitution that says, “You may speak freely and create artistically… except when it comes to children.” Not all creative endeavors are going to be the Mona Lisa; some will offend, some will disgust, some will bore. It is absolutely vital that we defend the right of people to speak and create ESPECIALLY in situations where the creation offends our sensibilities.

    Evan Emory exposed no child to any sexually explicit material. His editing is no more morally objectionable than Candid Camera and Emory’s video wasn’t even “candid” — it was fake. It is not and will never be immoral or unlawful to create fiction.

    It is astonishing to me that people like you are willing to use the government’s police power to destroy a human life so callously. This should be a civil matter and nothing more. It should never be the government’s place to seize, fine, imprison, and stigmatize a man when that man has DONE NO HARM.

I’d certainly be writing to Facebook formally requesting that the picture be taken down and administrative action be taken (as that would be a pretty clear violation of the terms of service). And if I had any pictures of my kids on FB (which would be unlikely after an incident like that), I’d hide them behind tight security settings so you didn’t have access to them. But no, as inappropriate and offensive as your scenario is, neither I nor most rational people would be calling for that person’s arrest.

    And the explicit lyrics weren’t even being directed toward the children to begin with. If a musician is at a concert and they sing a love song, does that mean they’re personally telling the audience that they love and have feelings for them? No. It’s just a song.
    I understand the whole ‘putting it up without parent’s permission’ thing but this is NOTHING worth sending him to prison. AT WORST they should just have the video removed and have him apologize.

Maybe California’s child sexual abuse laws are less stringent than Michigan’s because the episode of “Chappelle’s Show” where they sing songs about STDs is definitely in the same vein as this guy’s video. Regardless of whether the kids in either video had permission to be in the video or not, it wouldn’t change the way the law applies to this situation. And It sounded like the kids did have permission to be videotaped, the guy just wasn’t truthful about his intentions for the video. That would be the school’s fault for not getting in writing what the purpose of the video was before letting someone videotape the students. If he gets indicted, I think this case will definitely be one for the record books. Their child sexual abuse law should be altered anyway if it is so strict that even talking about sex in front of a minor is considered sexual abuse. If that’s the case, sexual education is a felony. Their law, the way it’s written, seems unconstitutional.

    This kind of thing happens ALL THE TIME. Has anyone ever seen Wonder Showzen? (that show was on national TV and had kids themselves spewing vulgarities and suggestive language that was equally if not more ‘offensive’ than what went on here) How about on the Chappelle show where a crackhead goes into an elementary school classroom and tells all the kids how great drugs are and how to score them? How about on the show ‘Weeds’, where a 12 year old boy is taken to an Asian massage parlor to get his first handjob, and then proceeds to tell all his friends at school about it.

    I can safely say this guy has done nothing that we haven’t already seen countless times on TV and in the Movies.

    This hysteria over satire needs to stop.

  49. it seems as though he did not tell the school or the parents or the children that he would be editing the song they heard with another song into a video which made it look as though the children were listening to an explicit song… perhaps if he had asked if the children could be shown this way he would not have been allowed to sing? he was wrong to make the video under such false pretenses, regardless of who was ‘abused’ or not

    Teenagers tried as adults (“You can’t drink beer but you’re old enough to fry on the chair”)…
    Teenagers turned into sex offenders for stupid mistakes that hurt nobody…
    So what is all this “Think of the children” about? I do not think that making sure they are mentally sane and not traumatized when they go to jail makes a big difference to them.

  51. No, “Auto-Tune the News” is not in the same category. All the images used by “Auto-Tune the News” are public images of public figures that perfectly know that their image can be used in news and other places. These people are in the real news to be seen in the first place, and as political figures they are perfectly aware that their image can be used against them, even by political adversaries. Now, this has nothing to do with the children in their school. The problem here is the right to protect its own image, which is considerably much complex in that case than in the case of a political satire. Even if the song were not depicting sexual elements at all, there would still be a real problem, because the parents were deceived in the process. The sexual thing is just a little excuse for some parents to attack very abusively, and it is clear that no sane judge or jury will put someone in jail for twenty years for a matter like this one.

  55. This is completely ridiculous. If my kid had been in the video, I would have asked for her to be removed (since I wouldn’t have consented to have my kids pictures posted on Youtube), but that’s about it. An arrest is ludicrous and a possibly 20-year sentence is positively Orwellian.

  56. I think this is just a very bad case of psychological hacking. Contents MADE viewers think that the kids watched a performance of a “adult” song. This is framing manipulation at its very best. Even after viewers knew that the video was a very clever edit of two clips (and that the crime was probably only a violation of trust), they use that “crime” to validate the fact that some wrong was done. Nothing really takes away the initial impression that Evan is a Child Sex Predator.
    Apology? Yes. 20 years of jail and branding as a child sex predator? That’s just making a mockery of criminalisation of sex crimes and child pornography.

    While I believe it was wrong for him to put those kids’ faces in his raunchy video, his disclaimers should be enough to free him from any obnoxious jail time.

    Think of this: the advertisement at the bottom of my page right now is for Honey Bunches of Oats, and it says “120 Calories.* Great Taste.” The disclaimer says “*Per Serving. See product package for details.”

    His motive or reason would have been for a dare and joke knowing that he would have received some bad reactions. I do not beleive that he did this deliberately or intentionally to hurt any child and in reality no child was sexually abused. If he knew that the outcome of his actions where this serious he would not have taken this course of action.

    He needs to grow up and take responsibilty for his actions.

    A potential 20 year jail sentence for this is way too harsh and not warranted. He should make an open apology at the school in question to those parents who are offended by his actions and he should be given a caution and maybe donate some time or money to the school in question in a postive manner.

    Live at let live is a good philosophy, also learn to forgive all people make mistakes and yes i know anything related to sex and children today is a very emotional subject and by now i think he already knows this.

    Parents today tend to be far more over protective because with all the modern technology and internet and with the media hype concerning pedophilia we now live in a society that is very sensitive and even paranoid where as 20 to 30 years ago kids could walk to the park or school on their own with very little worry from their parents.

    Again no child was sexually abused he was just very inmature and very irresponsible in his actions and an open apology at the school to the parents concerned along with a caution would be sufficient action in relation to this matter.

  62. Parents should be careful about exposing their children to pop music on the radio today. Pop music is loaded with sexually explicit ideas and is listened to by people of all ages. If Evan’s edited video was seen as that much of a sexual offense, then imagine what a parent exposing their children to pop music would be counted as.

  65. That is a perfectly reasonable statement. I think most people would agree with it.

    On the other hand, the charges against Evan have nothing to do with using video images of the children without permission.

    I would support efforts to get the video removed or maybe even civil damages on the grounds that he used images of the children without permission, but the charge that he has created child sexual abusive material is ridiculous.

  68. Appreciate your response and feedback. Admittedly, my response was basic and did not touch on the topic of the charges or the fairness of the repercussions.

    I agree that the charges, which are the highlight, and draw, of this story, are ridiculous. I would not wish a sentence involving jail/prison time and a forever-record involving sex crimes on anyone not truly deserving of such a punishment.

    One of the key points involving this situation, with respect to many comments involving comparisons to other comedians, productions, etc., is that comedians and productions have obtained permissions through legal anda moral processes, designed and put in place to avoid situation such as this.

    The bottom line issue and problem is motive and intent and resulting actions. He seemingly, purposely, intentionally, with premeditation, misled members of our society to which we [should] hold highest regards, safety, and protection for, by lying to them, going behind their backs, and doing something other than what he purported and indicated he would be doing.

    When people do that to me, personally, in everyday life, on any level, I get irritated, scared, question myself, question others, and it affects my day and my days going forward.

    I do not want to be lied to, misled, tricked, abused, made to look the fool, etc. at any time, privately or otherwise, … and certainly not in front of the entire world, without my permission, through someone else’ misleading profiteering, at my and others expense.

    One could repeat the same statement I just made above, but replace the “I” with “my child”, and my position would be much more aggressive, chaotic, and potentially dangerous and uncontrollable. Hence, the common sense protections created for society to follow, to avoid such dangerous and inflammatory situations.

    In summary, I disagree with the choices he made, morally and legally. I believe he is an excellent candidate to be made a superior example of, by his own choice. However, the harshness and inappropriateness of the charges and damage that would be done to that young man’s life and reputation are also inappropriate and unrealistic.

  72. As the mother of a child who was sexually abused, I find this story very upsetting. These children were not harmed in any way and it’s completely ridiculous to put that kid in jail. The fact that he put up those disclaimers show that he didn’t intend any harm. This story does nothing but give people the general idea that child abuse isn’t all that bad as people think it is and it makes the real victims like my daughter look like a joke.

    The only thing that I see that he did wrong was not taking the permission of all the parents before putting the video online. If this video was done by Hollywood, the parents would’ve been proud of their kids, but since it’s done by a 20 year old on youtube, it’s child abuse?
    Shame on them.

OK I have not seen the clip, and I do not agree with the ridiculous concept that this could bring a 20 year sentence – how about a bit of common sense – rapists and murderers get those sentences, not a guy who was just stupid… he’s not a career criminal, just not very bright. I dont agree with making a clip that makes it appear that young children are listening to, and apparently enjoying a vulgar song (if thats truly what it was), so maybe a fine and stern warning – along with his being made to write a full apology, and the removal and destruction of the video clip, OK, but 20 years…thats plain idiotic. Your country is really in a mess when you cant get such a simple thing right.

  76. How is what he did any different than the stuff you see in TV and Movies, where little kids are involved with adults in adult situation. This is ridiculous. For example this tv show on the FX Channel, the guy is singing about sexual intercourse with what children that “Appear” to be present.

  77. He did do something wrong: he filmed other people’s children at an elementary school and put it on YouTube. That is not right, I guarantee you it’s illegal. Now does he deserve 20 years as a sex offender? No. But he certainly shouldn’t be able to go into a school, film children under false pretenses, and post that on the Internet. That’s a violation of THEIR rights and their parents rights. If my kid was on that video I’d be suing the heck out of this guy and the school.

  78. To the people defending this guy: you do realize not one parent gave their permission to have their child filmed for this? How is different than something done in Hollywood? Do you really need to ask that? Do you have kids? I’d be furious if I found out my child was used as a prop in an Internet video (at school no less!) It has nothing to do with his right to free speech and everything to do with the rights of the children and the families who were violated. THAT’S what they should be going after him for. 20 years as a sex crime isn’t right, but if I went into a school to get video footage of children without their permission to put on the net… well let’s just say I’m not that dumb nor would I ever think that’d be acceptable.

  86. The charges can’t stick; his only applicable crime is violation of an understanding of privacy; he may have gotten permission to film, but he did so under false pretenses. That’s actually illegal, if only a misdemeanor. It’s also actionable under civil law, but I guess the parents are a little miffed that he doesn’t have much money to action against.

    If he had gotten stock footage of a classroom and after-effected himself singing explicit lyrics into the scene, would he be guilty of a crime? No. This situation is only distinguished from that by an agreement to film under false pretenses.

I fucking hate that it’s okay for lyrics like those in the majority of 50 Cents songs-which are misogynous in nature 80 percent of the time- to get parlayed to elementary schoolers, but when ONE joker puts out a video where kids aren’t actually being exposed to such idiocy but it’s made to look like it is, and they’re thinking of sticking him for one silver anniversary in prison.
